NKSS Terms & Conditions, version 1.03. Date 1st Feb 2018

The following terms explain your's and our rights, obligations and responsibilities under the agreement constituted by these conditions. It is important that you read, understand and accept these conditions as they form the basis of our agreement for storage of your goods at NKSS and can only be altered by written agreement prior to the period of storage. Please note all references to “customer”, “you” and “your” relate to you the Customer who has requested the storage facility. References to “us”, “our” and “we” relate to North Kent Self Storage (NKSS).


General Terms:

NKSS reserves the right from time to time to impose and/or alter regulations concerning acceptable items for storage, hours of customer access, general management and security of the storage complex. You will be advised of any such changes by written notification to the address noted for invoice purposes.

Ownership of Goods Stored:

You warrant to us that all goods stored are owned by you or that the person or persons who own or have a legal interest in them have given you authority to store the goods on their behalf and accept full legal responsibility for them.

Prohibited Items:

Items which are expressly prohibited from storage include items which may present a risk to health and safety and any items which carry other unspecified risk for the fabric of the NKSS facility or the stored contents therein.

For the avoidance of doubt, the following items are examples of goods which must not be stored within the NKSS facility – plants, living creatures, perishable, inflammable, illegal or stolen goods; potentially dangerous, damaging or explosive items; anything requiring a controlled environment; jewellery, watches, sensitive electronic equipment.

If you store any such prohibited items and we become aware of such we will endeavour to make them available for your collection and if you do not collect them within a reasonable time we will dispose of such goods without further recourse to you. In addition you will be liable to indemnify us against any charges, expenses, damages, penalties, legal and administrative costs incurred by us in relation to such prohibited goods. Furthermore we will not be liable to you for any damage or loss incurred or suffered by you as a result of our disposal or destruction of the prohibited goods.

Customer Access:

Customer’s right of access to their storage unit is confined to the Access Periods advised by NKSS. Currently Customer Access Periods are 8am to 7pm daily excluding 25th and 26th December.

NKSS reserves the right to alter Customer Access Periods at will.

Only persons authorised by Customer are permitted access to the unit or units to which the contract relates.

Payment:

Payment for the initial period of hire must be paid in full prior to commencement of the hire period.

Subsequent invoices, for extension of the initial hire period, must be paid in full not less than seven (7) days prior to the start of the new hire period.

Termination:

The contract for storage is deemed to expire at the end of the contract hire period (hire period as defined by the end date of a fully paid hire contract).

Customer may terminate their storage contract with NKSS by giving not less than two (2) full weeks notice of their intention. In the event customer terminates the agreement NKSS will refund the monies paid based on the number of full weeks (7 day periods) upto the end date of the existing, fully paid, customer contract.

On termination of the storage contract Customer agrees to remove all their goods and possessions from the NKSS facility and return the rental unit in the same state of decoration and repair as at the beginning of the contract period.

NKSS Limited Liability:

NKSS accept responsibility for maintaining your storage unit free from rising damp or water incursion through the roof or insulated external walls.

If you provide us with an itemised declaration of the value of your goods prior to storage the amount of our liability to you in the event of loss or damage to your goods arising from our negligence is limited to £1,000.

Other than as a result of our negligence we will not be liable for any loss or damage caused by any of the following circumstances:

- War, terrorism, Act of God, industrial action, strike or other events outside of our reasonable control.

We do not accept any responsibility whatsoever in respect of:

- Loss or damage caused by Moth, Vermin, or any gradually operating cause, loss of market, electrical failure, mechanical failure or derangement.
- Loss or damage to jewellery, furs, perishable goods of any nature, living things, bank notes, bonds, cash, currency, stamps, securities, artwork, antiques or the likes.

If you require additional levels of insurance you may ask that we provide it (at additional cost to you) or you may procure it yourself.

If you secure additional insurance you are obliged to advise of such additional insurance plus provide us with copy of the relevant insurance schedule.

Non-Payment of Storage Fees:

Storage fees are due for the entire period that your goods remain in storage with us. Should your goods remain in our storage past the end of a fully paid hire period NKSS have the right to take any steps deemed necessary to recover monies owed. You will be denied entry to the NKSS facility and your goods will be subject to a lien and may, after 28 days, be disposed of by us to cover all unpaid storage costs plus reasonable legal fees, sale costs, administrative fees and the like expended to recoup the monies owed. Please note that weekly storage costs will continue to accrue to the point of final removal of your goods from NKSS storage. In the event your good are disposed of by us if there is a surplus of monies raised over monies due such surplus will be repaid to you, if there is a deficit of monies raised over monies due you remain liable for the remaining monies due plus our reasonable legal, administrative and other such costs associated with our efforts to recover it.

Data Protection:

Except as demanded by the Courts, Police or other legally instructed body NKSS will not disclose your personal information or details of your rental contract with any third party.

Whilst on our premises your image and the image of any vehicle driven onto site may be recorded via CCTV. Such images are for the purposes of ensuring security of the facility and may be kept for up to ninety (90) days.
